A federal judge says that a two -year -old American citizen may have been deported to Honduras with her mother and her 11 -year -old sister without legal procedures amid the Trump administration campaign to intensify the deportation.
In the court file, Judge Terry Duti said that there was “strong suspicion” that the child – who was identified only in the name of VML – was deported “without a meaningful process.”
The child born in Louisiana and her family members were arrested at a routine date in a migration office in New Orleans on April 22, according to the documents.
A spokeswoman for the Ministry of Internal Security said the mother wanted to take her children with her when she was sent to Honduras.
According to the court documents, the judge sought to arrange a phone call with the girl's mother, but a government lawyer told her that “it will not be possible because she (assumed that VML) had been released in Honduras.”
The migration of the mother of the girl, the father and her sister is still unclear. The two -year -old is an American citizen.
The judge said: “It is illegal and unconstitutional to deport or detention the deportation or recommend that an American citizen be deported.”
It is scheduled to hold a hearing on May 19 “in order to dispel our strong doubts that the government has just deported an American citizen without any meaningful operation.”
“The father made a decision to take the child with them to Honduras.” Said the American partner, Tricia McLulin, said, “The father made a decision to take the child with them to Honduras.”
“It is common to want to remove it with their children.”
Earlier this week, the girl's father also applied for a temporary transfer of legal authority, according to the state law that would give his sister – an American citizen – also – a nursery for children.
However, a customer to enforce immigration and customs (ICE) spoke to the family lawyer and “refusing to honor the request” and said that “the father can try to capture it, but it will also be detained.”
In a second case, a similar case was held in Florida, a Cuban woman and has one wife and husband of an American citizen at a specific date for immigration and returned to Cuba after two days, according to media reports.
The woman, who was determined as Heidi Sanchez, was still breastfeeding her daughter, who suffers from attacks, according to her lawyer. He argued that Mrs. Sanchez was not criminal and should have remained in the United States on a humanitarian basis.
Thousands of illegal immigrants have been arrested since Donald Trump returned to the White House on January 20.
Trump's strict immigration policies faced a number of legal obstacles.
At the highest prominent case, the government admitted that it had accidentally deported the national Salvador ábrego GarcÃa, but claims to be a member of the MS-13 gang, which his lawyer and his family deny. Mr. ábrego GarcÃa has not been convicted of a crime.
The Supreme Court unanimously ruled that the government must facilitate the return of Mr. ábrego GarcÃa, but the Trump administration said it would not live in the United States again.
