The Trump administration filed a lawsuit against officials in Illinois, Chicago, and Cook Province on Thursday over policies that limit cooperation with federal immigration enforcement authorities, accusing them of obstructing the immigration campaign.
It is the first major challenge of administration against democratic cities and countries that have opposed the use of local law enforcement to help the federal government to impose civil immigration laws. Trump officials have repeatedly criticized these policies, often excluding Chicago, as the administration recently conducted the enforcement of immigration.
The Ministry of Justice said that it plans to be aggressive against the so-called cities of the haven-a term that is widely applied to places that have policies designed to reduce cooperation with or participate in the procedures for enforcement of federal immigration.
“The rulings faced by Illinois, Chicago and Cook County Law have a purpose and impact on making it more difficult for the ability of federal immigration officers and intentionally disabled their responsibilities in these judicial authorities,” the lawsuit says.
The administration argues that government laws and local laws violate the condition of the supremacy of the constitution, which states that federal laws have precedence over state laws.
“The requirement for excellence prohibits Illinois, Chicago, Cook County, and its officials from obstructing the ability of the federal government to implement the laws that enact Congress or take its actions that the constitution entrusted.”
The Ministry of Justice requests a federal judge to declare unconstitutional laws and prevent them temporarily during litigation.
Among the rulings that challenge the laws of states prohibiting law enforcement officials in Illinois is to participate with federal officials regarding the implementation of civil immigration laws. The state law, however, still requires Illinois officials to work with federal officials on the enforcement of criminal laws.
In its complaint, the Ministry of Justice argues that the laws “hinder the ability of the federal government to regulate immigration and take enforcement measures against illegal foreigners by preventing law enforcement officials in the state from helping to implement federal civil immigration.”
“The state will defend our laws that give priority to police resources to combat crime while enabling law enforcement in the state to help arrest violent criminals.”
Pritzker said: “The Illinois confidence law from the two parties, which was signed by a Republican governor, has always been compatible with federal law and is still today,” said Pritzker. “We look forward to seeing them in court.”
“The province is still committed to be a fair and welcome society.”
“Our policies reflect our long values ​​and make sure that local resources are used to enhance public safety and society's confidence,” said Brekohwing, a democratic, in a statement. “We will review the complaint and the response accordingly.”
